This page contains the legally required statements, policies and disclosures that govern your use of our artificial-intelligence image-editing and text-to-image generation service (the "Service"). These documents apply to users located in the United States, the United Kingdom, the European Economic Area, and other international regions. By accessing or using the Service, you agree to be bound by the terms set out below.

1. Privacy Policy

This Privacy Policy explains how we collect, use, disclose and protect your personal information when you use the Service. It is designed to comply with the California Consumer Privacy Act (CCPA/CPRA), the General Data Protection Regulation (GDPR) and the UK GDPR, and other applicable U.S. state privacy laws (including but not limited to the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and the Texas Data Privacy and Security Act).

1.1 Information We Collect

• Account Information: email address, display name, profile image and account identifiers when you register or sign in through a third-party provider (e.g., Google, GitHub, Microsoft).
• Usage Information: the images you upload, the prompts you submit, the images we generate, your session activity, page interactions and feature usage.
• Payment Information: credit balances, purchase and subscription records. Payment card details are processed by our third-party payment processors and are never stored on our servers.
• Technical Information: IP address, browser type, device identifiers, operating system, approximate geolocation and log data.

1.2 How We Use Your Information

• To provide, operate, maintain and improve the Service.
• To process your image-editing requests using AI models.
• To manage your account, authenticate you and process payments.
• To communicate with you about the Service, updates and support.
• To detect, prevent and address fraud, abuse, security or technical issues, and to enforce our Terms of Service.
• To comply with legal obligations and lawful requests from authorities.

1.3 Legal Bases for Processing (GDPR / UK GDPR)

If you are located in the European Economic Area or the United Kingdom, we process personal data on the following legal bases:

• Contract performance: to provide the Service you request.
• Legitimate interests: to improve the Service, ensure security and prevent abuse.
• Consent: where we rely on your consent, you may withdraw it at any time.
• Legal obligation: to comply with applicable laws.

1.4 Sharing & Disclosure

We do not sell your personal information. We only share your information with:

• Service providers: hosting providers, AI model providers, payment processors and analytics providers that process data on our behalf under appropriate safeguards.
• Legal requirements: where required by law, regulation, legal process or governmental request, or to protect our rights, safety or property.
• Business transfers: in connection with a merger, acquisition, reorganization or sale of assets.
• Public content: if you choose to share a generated image to a public feed, that image and its associated prompt may be visible to other users.

1.5 Your Privacy Rights

Depending on your jurisdiction, you may have the following rights regarding your personal information:

• The right to know what personal information we collect, use and disclose.
• The right to access and obtain a copy of your personal information.
• The right to correct inaccurate personal information.
• The right to delete your personal information.
• The right to object to or restrict certain processing.
• The right to data portability.
• The right to opt out of the "sale" or "sharing" of personal information (we do not sell or share your data).
• The right not to receive discriminatory treatment for exercising your privacy rights.
• The right to lodge a complaint with a supervisory authority (for EEA and UK users).

1.6 Do Not Track & Global Privacy Control

We honor Global Privacy Control (GPC) signals. Where required by law, we also honor "Do Not Track" (DNT) browser signals to the extent we engage in tracking that would be affected.

2. Cookie Policy

We use cookies and similar technologies (such as local storage) to operate the Service and improve your experience.

2.1 Types of Cookies We Use

• Strictly Necessary Cookies: required for authentication, session management and security. These cannot be disabled.
• Functional Cookies: remember your preferences, such as theme selection and saved editing settings.
• Analytics Cookies: help us understand how the Service is used so we can improve it.
• Local Storage: used to persist your in-progress image editing settings on your own device.

2.2 Managing Cookies

You can control or delete cookies through your browser settings. Disabling strictly necessary cookies may prevent the Service from functioning correctly. For users in the EEA and UK, where consent is required for non-essential cookies, we will obtain your consent before placing them.

3. Terms of Service

3.1 Acceptance of Terms

By creating an account, purchasing credits, or otherwise accessing or using the Service, you agree to be bound by these Terms of Service and all documents incorporated by reference, including our Privacy Policy and Acceptable Use Policy.

3.2 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3.3 Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when registering.
• You must not create multiple accounts to circumvent restrictions, abuse promotions, or otherwise violate these Terms.
• We may suspend or terminate accounts that violate these Terms or pose a security risk.

3.4 License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own lawful, non-commercial or commercial purposes. You may not resell, sublicense, or redistribute access to the Service without our prior written consent.

3.5 User Content and Generated Content

• Your Content: You retain all rights to the images and text you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to process, store and transmit that content solely for the purpose of providing the Service to you.
• Generated Content: Unless otherwise stated, you own the images generated by the Service based on your inputs. To the extent permitted by applicable law, we disclaim any warranty of ownership, originality or fitness of AI-generated content.
• Warranty of Ownership: You represent and warrant that you own or have the necessary rights, licenses and permissions to the content you upload, and that such content does not infringe the rights of any third party.

3.6 Fees, Credits and Payments

• The Service may be made available through credit purchases or subscriptions. All fees are stated in the currency displayed at checkout and are exclusive of applicable taxes unless stated otherwise.
• Credits are consumed when you submit generation requests. Unused credits are non-refundable except as required by applicable law.
• All payments are processed by our third-party payment processors. By making a purchase you agree to their terms.
• We may modify pricing from time to time. Changes will not apply to already-purchased credits unless required by law.

3.7 Refund Policy

Except where required by applicable consumer-protection law (such as the EU/UK right of withdrawal within 14 days for digital services not yet performed), all purchases of credits are final and non-refundable. If you believe a charge was made in error, contact us within 14 days of the charge and we will investigate.

3.8 Prohibited Uses

You may not use the Service to generate or distribute content that:

• Depicts minors in sexual or exploitative situations (CSAM) or sexual content involving non-consenting persons.
• Is illegal, obscene, defamatory, hateful, harassing, threatening or discriminatory.
• Depicts real individuals in a false, defamatory or non-consensual context (including deepfakes and impersonation).
• Infringes intellectual property rights, publicity rights or privacy rights of others.
• Promotes violence, terrorism, self-harm, fraud, or dangerous or illegal activities.
• Contains malware, viruses or other harmful code.

3.9 Intellectual Property

The Service, including its software, design, trademarks, logos and documentation, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, decompile, reverse engineer or create derivative works of the Service except as expressly permitted by law.

3.10 Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time if you violate these Terms, if we suspect fraud or abuse, or if required by law. Upon termination, your right to use the Service ceases immediately.

3.11 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL MEET YOUR EXPECTATIONS OR BE FREE OF ERRORS OR INACCURACIES.

3.12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

3.13 Indemnification

You agree to indemnify, defend and hold harmless us and our officers, directors, employees, agents and affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your uploaded content, your violation of these Terms, or your violation of any rights of a third party.

3.14 Governing Law and Dispute Resolution

United States: These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved through binding individual arbitration administered by a recognized arbitration provider, subject to applicable federal and state law, with each party bearing its own attorneys' fees unless otherwise required by law. You may bring claims in small claims court if they qualify.

United Kingdom and European Economic Area: If you are a consumer located in the UK or EEA, nothing in these Terms deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and any disputes may be brought before the competent courts of your country of residence.

3.15 Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after the effective date of the changes constitutes acceptance of the updated Terms.

4. Acceptable Use Policy

This Acceptable Use Policy sets out the rules for using the Service responsibly and lawfully. In addition to the Prohibited Uses in Section 3.8, you agree not to:

• Attempt to gain unauthorized access to the Service, our systems or other users' accounts.
• Use automated tools, bots or scrapers to access the Service without authorization.
• Attempt to probe, scan or test the vulnerability of the Service.
• Interfere with or disrupt the Service, servers or networks connected to the Service.
• Use the Service to create, distribute or promote spam or unsolicited communications.
• Misrepresent your identity, affiliation or the origin of your content.
• Circumvent any rate limits, restrictions or technological protection measures.

5. AI-Generated Content Disclaimer

The Service uses artificial-intelligence and machine-learning models to generate and edit images based on the prompts and content you provide. You acknowledge and agree that:

• AI-generated output is created algorithmically and may contain errors, inaccuracies, distortions, or unintended similarities to existing works or real persons.
• We do not guarantee that generated content is original, unique, or free from third-party intellectual-property claims. You are solely responsible for verifying that your use of generated content does not infringe any rights and complies with applicable law.
• Generated content should not be presented as human-created where applicable law (including certain U.S. state deepfake laws and the EU Artificial Intelligence Act) requires disclosure of AI-generated material.
• Inputs you provide may be transmitted to third-party AI model providers to fulfill your request. You should not upload content containing sensitive personal information, trade secrets, or confidential data.
• We do not exercise editorial control over user inputs and are not responsible for content generated from user-supplied prompts that violates these Terms.
• If you use generated content for commercial purposes, you should consult legal counsel regarding applicable rights, clearances and disclosures.

6. DMCA / Copyright Policy

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content on the Service infringes your copyright, you may submit a written notice to our designated Copyright Agent containing the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and information reasonably sufficient to locate it.
4. Your contact information (address, telephone number and email address).
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We will respond to valid DMCA notices and may remove or disable access to infringing material and terminate the accounts of repeat infringers in appropriate circumstances. Counter-notifications may be submitted by the affected user in accordance with 17 U.S.C. § 512(g). For the United Kingdom and EEA users, equivalent copyright complaints should be directed to us using the same contact details.

7. Children's Privacy

The Service is not directed to children under the age of 13 in the United States (in accordance with the Children's Online Privacy Protection Act, COPPA), or under the age of 13 in the United Kingdom and EEA (in accordance with the UK Age Appropriate Design Code and GDPR), or under the minimum age set by your local jurisdiction. We do not knowingly collect personal information from children. If you believe that a child has provided us with personal information, please contact us, and we will take steps to delete such information promptly.

8. Data Security & Retention

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure or destruction, including encryption in transit, access controls and secure authentication. We retain your personal information only for as long as necessary to provide the Service and to comply with legal, accounting and reporting obligations. When personal information is no longer needed, we delete or anonymize it in accordance with our retention schedules.

9. International Data Transfers

If you are located outside the United States, your information may be transferred to and processed in the United States and other countries where our servers and service providers operate. For transfers from the EEA, UK and Switzerland, we rely on appropriate safeguards, including the European Commission's and UK's adequacy decisions where available, or Standard Contractual Clauses (SCCs) with our service providers. By using the Service, you acknowledge and consent to such transfers to the extent permitted by applicable law.
